Please read these terms and conditions carefully before registering to use our services on any electronic platform, before contracting directly with us, and before using our services in general. By electronically using this site or any of our services, you acknowledge that you have read and agree to be legally bound by these terms and conditions. By initiating use of this site or contracting for our services, you will be deemed to have read and accepted these terms and conditions. If you use this site or any of our services electronically, you acknowledge that you have read and agree to be bound by these terms and conditions in their entirety and to the fullest extent permitted by law.
The following terms and conditions of use (the “Terms of Use”) apply to all services, mobile applications, and platforms owned and offered by “Language Leaders”.
For the purposes of these Terms of Use, a user is: (i) the general public and/or (ii) a customer of Language Leaders who has created a user profile through our Portal and/or mobile application and/or contracting any of our services through the Portal and/or mobile application or (iii) anyone who is an official of a customer of Language Leaders and who uses the Portal to receive the services offered by Language Leaders to the general market (the “User”). The User fully and unconditionally accepts the Terms of Use of the Portal and the Privacy Notice published on the Portal (collectively, the “Legal Notice”). Language Leaders reserves the right to update or revise these Terms and Conditions without prior notice and without the need to obtain the prior consent of any third party; please check these Terms and Conditions periodically to be aware of any changes, without any liability to Language Leaders. Your continued use of this site following the posting of changes to these terms and conditions constitutes your unreserved acceptance of those changes.
Language Leaders offers a portfolio of services related to the development of technology or various language-related accessories, generally through our Portal and Platform, as described on the Portal (the “Services”). Language Leaders is not affiliated with any political or governmental organization.
The material contained on the Portal is for informational purposes regarding the Services offered. These Terms of Use govern the use of the Portal, mobile application as well as any technology that Language Leaders may use to provide its services to the general market (the “Platform”), and your access to it constitutes a binding contract (the “Agreement”) between Language Leaders and the User. The legal notice is binding on all users. If the User does not agree with the Legal Notice, in whole or in part, they should refrain from using, operating, visiting the Portal, the Platform, and/or contracting the services provided by Language Leaders.
By using the Portal, the Platform, or by electronically initiating its use, the User acknowledges that they accept the Agreement and acknowledges and accepts that (i) Language Leaders disclaims any responsibility, loss, damage, or risk that may arise as a direct or indirect consequence of the use of the Portal, the Platform, or the Services; (ii) the use of the Portal and the Platform is subject to the terms of the Legal Notice, as it may be modified from time to time; and (iii) they will only use the materials contained in the Portal and the Platform for personal, non-commercial, and informational purposes and will not modify any of the materials contained therein.
General Description of the Services
Language Leaders is a language practice platform that provides advanced AI technology. Our services encompass the following:
User Account Creation: Any user wishing to access Language Leaders’s services must create an account. This process involves providing personal information, including but not limited to, the user’s name, email address, phone number, and a valid payment method.In general terms, and subject to any more detailed substantive or procedural provisions that may be implemented through the Portal or the Platform for the provision of the Services: (i) you may register with a username and password; (ii) you must provide all the information necessary for the proper and timely provision of the Services; and (iii) the provision of the Services will be governed by the instructions made available by Language Leaders from time to time on the Portal and/or the Platform, which the User must follow for the proper provision of the Services.
Interaction with AI Avatars and Chatbots: We offer a unique experience through interaction with AI Avatars and chatbots via interactive sessions as well as chat messaging. This approach facilitates natural and practical language learning.
Flexible and Personalized Learning: Our platform allows for flexible scheduling and personalized learning experiences. Students can interact with AI Avatars and Chatbots at their convenience.
Subscription-Based Model: Access to our services is provided on a subscription basis. Language Leaders reserves the right to pause or stop a user’s account at any time if a certain usage threshold is crossed.
Data Protection and Privacy Compliance: Language Leaders is committed to maintaining the highest standards of data protection and privacy, adhering to international data protection laws to safeguard user information.
App Usage and Compatibility
For the optimal use of the Language Leaders app, users must ensure their devices meet specific system requirements. These requirements include, but are not limited to, a compatible operating system (iOS or Android), sufficient memory and storage space, and an adequate network connection. The latest version of the app may require more recent hardware or software specifications; thus, we recommend users keep their devices updated to the latest standards supported by their device manufacturer. Language Leaders is not responsible for performance issues arising from users’ devices not meeting these system requirements. Users should refer to the device settings for detailed information on compatibility requirements.
Language Leaders regularly updates the platform to enhance user experience, introduce new features, and maintain security. Users may or may not be notified of significant updates and any maintenance that might affect app availability. We strive to minimize downtime and inconvenience during these periods.
Security channels and filters
Language Leaders may, at its sole discretion, implement security filters that it deems appropriate to evaluate Users and determine whether the information provided by a User is reliable and secure, and to decide, at its sole discretion, to provide or suspend services to a User. From the moment a User registers on the Portal or the Platform, the Language Leaders team may filter them to protect the integrity of its employees, agents, partners or shareholders, consultants and collaborators directly or indirectly involved in the provision of the Services.
To use the services offered on the Portal, you may be required to create an account and choose a password. In such case, you are fully responsible for maintaining the confidentiality of your account information, including the password, and for all activities that occur under your account because of your failure to maintain the confidentiality and security of such information. You agree to notify Language Leaders immediately of any unauthorized use of your account or password, or any other breach of security. You may be held legally responsible for losses incurred by Language Leaders or any other user or visitor to the Portal due to the use of your account or password by another person because of your failure to maintain the confidentiality and security of your account information.
Similarly, Language Leaders reserves the right to terminate a user’s account (free or active) temporarily or permanently in the event of non-compliance with the following section on User Behavior.
At Language Leaders, we prioritize the privacy and safety of our instructors. To this end, we have implemented the following measures:
Persona Creation: each AI Avatar and Chatbot is created with a professional persona. This may include adopting a fictional backstory regarding their personal history, such as their place of upbringing or current residence.
Profile Images: Chatbots may include profile pictures that are not real photographs. These images could be AI-generated or sourced from models who have provided their consent and have legally agreed to the use of their images for this purpose.
We ask our users to respect these measures as they are crucial in maintaining a safe and respectful environment for language learning. Please note that these measures do not affect the quality or authenticity of the instructional services provided by our instructors, who are thoroughly vetted for their language proficiency and teaching capabilities.
User Behavior
The User agrees to comply with all relevant local, state, national and international laws, regulations, rules and ordinances, and is solely responsible for all acts or omissions that occur as a result of using or accessing the Portal or the Platform, including, but not limited to, the content of his or her transmissions through or to the Portal or the Platform. Without limiting the generality of the foregoing, the User agrees not to do any of the following:
- Using the Portal or Platform in relation to the commission of property crimes or any other type, particularly in matters of money laundering and anti-corruption.
- Using the Portal or Platform in relation to chain letters, advertising email, spam email, or any duplicate or unsolicited, commercial, or other kind of messages.
- Collecting, compiling, or disseminating information about third parties, including email addresses or personal data, without the consent of the information or data owner.
- Creating a false identity or a forged email address or header or attempting in any way to deceive others about the sender’s identity or the origin of a message.
- Transmitting through or to the Portal or the Platform illegal, harassing, defamatory, abusive, threatening, harmful, vulgar, obscene, offensive, or objectionable materials.
- Transmitting any material that could infringe the intellectual property rights or other rights of third parties, including, but not limited to, trademarks, trade secrets, or copyrights.
- Transmitting any material containing viruses, trojans, worms, time bombs, cancelation programs, or any other harmful or malicious programs.
- Using the Portal or Platform to violate any relevant laws that restrict the export or import of data, software, or any other type of content.
- Interfering with, or disrupting, the operation of networks connected to Language Leaders’s websites or violating the rules, policies, rules, or procedures of such networks.
- Obtaining or attempting to obtain unauthorized access to the Portal or the Platform and Language Leaders’s websites or other accounts, computer systems, or networks connected to Language Leaders’s websites or the Platform, by searching for or illegally obtaining passwords or by any other means.
- Interfering with the use of the Portal or the Platform by any third party.
- Using the Portal or the Platform in an unethical manner.
- Using the Portal or the Platform to promote businesses for the benefit of a competing company or service.
- Using any form of “deep-link,” “data extraction,” “robot,” “spider,” or other automatic devices, programs, algorithms, or methodologies, or similar or equivalent manual processes to acquire, copy, or monitor any part of the Portal, or to access it, or to reproduce or bypass the navigation or presentation structure of the Portal to obtain or attempt to obtain materials, documents, or information by any means not voluntarily made available through it.
- Scanning, probing, or evaluating the vulnerability of the Portal or any network connected to it, as well as violating its security or authentication measures or any network connected to it.
It is expressly forbidden: (i) to use the Portal and/or the Platform and/or the Services for purposes that are illegal, immoral, obscene or prohibited by custom, applicable laws and/or the Legal Notice; (ii) to make any modifications, alterations and/or deletions, whether electronically or by any other means, using legal or illegal means, that may interfere with the administration or operation of the Portal and/or the Platform and/or the Services provided by Language Leaders.
The user also undertakes to behave in a respectful and friendly manner towards the teacher. Avoid malicious comments, racism, dark humor, insults, vulgarity, not disclose personal information, not send photos and videos with sexual content or content that may be offensive.
Language Leaders is committed to creating an inclusive and respectful environment for all users and instructors. Discrimination of any kind, including but not limited to, discrimination based on race, gender, sexual orientation, religion, disability, or any other protected characteristic, is strictly prohibited. Users are expected to adhere to this principle in all interactions within the platform. Any violation of this anti-discrimination policy may result in immediate suspension or termination of the user’s account.
The user will be responsible for any damages and losses caused to Language Leaders as a result of his actions or those of his officers, employees, agents, relatives, collaborators, and/or any natural or legal person associated, subsidiary, and/or affiliate.
If the user violates any of the points mentioned in the Terms and Conditions, Language Leaders has the right to cancel and/or suspend the user’s account without prior notice. Furthermore, the user shall not be entitled to any refund and/or compensation from Language Leaders. In cases of severe violations, including but not limited to harassment, discrimination, or illegal activities, Language Leaders reserves the right to take appropriate legal action against the offending user. Such actions may include cooperating with law enforcement authorities and pursuing civil remedies. The safety and security of our users are of utmost importance, and we are committed to upholding legal standards and ensuring a safe platform for all.
User Data Protection and Privacy
When registering for our Services or interacting with Language Leaders through our Portal or Platform, users may be required to provide personal information. This information is essential for delivering our Services and ensuring an optimal user experience. Our comprehensive Privacy Policy, which details our practices for the collection, use, storage, and protection of personal data, can be accessed directly through the Portal.
Language Leaders is committed to upholding the highest standards of data privacy and adheres to all applicable data protection laws, including the GDPR for our European users. By using our Portal and/or Platform, users acknowledge and consent to the terms outlined in our Privacy Policy. This includes our practices for handling personal data and the rights of users concerning their information, such as the right to access, correct, or request the deletion of their data.
Due to the complexities of obtaining verifiable parental consent under laws such as the EU General Data Protection Regulation (GDPR), Language Leaders does not knowingly allow individuals under the age of 16, or the age of digital consent as specified by local laws in their country of residence, to use our services. This includes, but is not limited to, countries in the European Union and regions with similar requirements for parental consent. Users affirming their registration with Language Leaders represent and warrant that they are at least 16 years of age or older, or have reached the age of digital consent in their jurisdiction.
Users bear the responsibility to provide precise, thorough, authentic, and up-to-date information. They also commit to promptly updating any alterations to the provided information to ensure continued accuracy and compliance with our data handling practices.
In the context of our app-based services, Language Leaders remains committed to protecting user data and privacy. Specific data collection and usage practices related to the app will be governed by our Privacy Policy, which is accessible through the app and our website.
Payment, Cancellation, Refunds, and Rescheduling Policy
The services provided are personal and non-transferable and may only be used by the contracted user. Users may reschedule services subject to availability and the rescheduling policy. The user must comply with the payment terms outlined in their service contract. Refunds may be issued in accordance with the terms and conditions of the service contract.
All credit or debit cardholders are subject to verification and authorization by the card issuer. By providing information about their credit or debit card for the procurement of services, the user agrees to use it for the corresponding charge and confirms that the card belongs to them and has enough funds or available credit to cover the charges.
Payment platforms are independent of Language Leaders and facilitate secure and agile transactions for users. For any questions or concerns about this payment system, please contact the appropriate payment platforms on the Portal or the Platform. Language Leaders assumes no responsibility for any issues that may arise from the operation or use of the payment platforms.
Users must comply with age restrictions set by the app stores. The app is not intended for children under the age specified by app store guidelines. The services of Language Leaders are intended for individuals who are of legal age or who have sufficient legal capacity to assume obligations, or for minors on behalf of their legal guardians in accordance with the applicable law, which must be duly verified by legal means. If users do not agree with or accept all of these Rules of Use or the content of the Legal Notice, they must immediately cease their use of the Portal or Platform. Language Leaders may delete or block any user from accessing the Portal or Platform at its discretion if it has a justifiable reason, as determined by the content of these Usage Regulations, Legal Notice, or Service Contract.
When contracting our services directly, you agree to pay Language Leaders the fees indicated on either the Portal or the Platform for the contracted services. Please note: If requesting changes to the original service ordered, these changes may incur additional charges. We reserve the right to update these fees at any time at our sole discretion. Payment will be charged upon contracting and/or consuming the services. By accepting these Terms and Rules of Use, the User authorizes Language Leaders to automatically charge their credit card, debit card, PayPal, or other payment method.
Language Leaders acknowledges that the User can cancel or pause their subscription anytime.
Language Leaders is not responsible for any failure or delay in providing services due to unforeseeable events or force majeure, such as natural disasters, wars, or other events beyond our reasonable control. In such cases, Language Leaders will endeavor to provide timely communication and reschedule services where feasible. For cancellations or modifications initiated by the user or their associated company, any related expenses shall be the responsibility of the user. Language Leaders will cover expenses only in situations where the cancellation or modification is directly due to our actions, excluding cases of force majeure. If disruptions or issues in service delivery arise from Language Leaders’s willful misconduct or gross negligence, we accept responsibility and will work to rectify the situation in accordance with applicable laws and our commitment to customer service.
Ownership Rights of Content of the Portal and Platform
Language Leaders owns and possesses exclusive rights under current laws and international treaties related to intellectual property for all trademarks, trade names, software, computer programs, and other legally protected elements governed by the Federal Law on Industrial Property Protection and the Federal Law on Copyright, pertaining to the Portal and Platform utilized to promote, market, and provide its Services, including but not limited to: (i) Industrial property rights for trademarks and trade names granted by the Mexican Institute of Industrial Property; (ii) all texts, graphics, user interfaces, visual interfaces, photographs, logos, sounds, music, designs, and computer code, including the design, structure, selection, coordination, expression, appearance, and arrangement of these elements. (iii) Copyright in computer programs, software developments, systems, and/or their derivatives, as granted by the National Institute of Copyright; and (iv) all developments, know-how, distinctive signs, assets, or rights pertaining to the intellectual property in its own right (the “Intellectual Property”).
Language Leaders does not grant any license or authorization for the use of the Intellectual Property. Therefore, the User acknowledges this fact. (i) Users have no rights to the Intellectual Property and must respect Language Leaders’s rights at all times. (ii) Users cannot modify, alter, delete, copy, or reproduce any part of the Intellectual Property, including the informational content generated by Language Leaders, or any indication on the Portal or the Platform.
Third parties
Service providers, manufacturers, and sellers of the devices used to access the Portal or the Platform, the creator of the User’s operating system, as well as the operator of any application store or similar service through which Users enter the Portal or the Platform to perform transactions (the “Third Parties”), are not a party to these Rules of Use or to Language Leaders, nor do they have any ownership or responsibility over the Portal or the Platform. Therefore, Language Leaders assumes no responsibility for any operational details that depend on Third Parties and may impact the provision of services through the Portal or the Platform. Third Parties do not provide any guarantees with respect to the Portal or the Platform, and Language Leaders does not provide any guarantees with respect to the services provided by Third Parties.
The Portal and Platform, along with their transactional means, are designed for the latest internet operating system versions available on the market. Compatibility issues may occur when using older versions. Wireless network coverage and Wi-Fi speed may vary depending on geographic region and provider. Language Leaders assumes no responsibility for any limitations or failures in the operation of any wireless or Wi-Fi service utilized to access the Portal or the Platform, nor for the security of wireless or Wi-Fi services. Furthermore, Language Leaders is not responsible for any data network usage fees or charges, which are the sole responsibility of the User.
The User acknowledges and accepts that Language Leaders uses artificial intelligence on its platform, which may be used to enhance user experience on the Language Leaders platform. Artificial intelligence may also be used for the creation and correction of documents related to the company’s business activities.
User-Provided Content
By submitting content to the Portal, or the Platform, the User grants Language Leaders the right to use, display, modify, distribute, or promote the content in any way and for any purpose, as outlined in the Rules of Use and the Legal Notice. The User ensures that the content is clear, concise, and free from grammatical or punctuation errors. Additionally, the User abides by formal writing standards, avoiding slang or colloquial terms while maintaining precision and professionalism. Language Leaders respects the User’s original meaning and quotes, only enhancing the clarity and conciseness of the content. Additionally, the User warrants ownership or control over the content and confirms that Language Leaders’s publication and use of the content does not violate any third-party rights or laws. The User takes responsibility for all content posted or submitted on the Portal or Platform. In such cases, the User agrees to grant Language Leaders a free and non-exclusive authorization to use the shared data. The User also agrees to hold Language Leaders and/or its subsidiaries harmless from any action, demand, or claim for any intellectual property violation arising from the use of shared data that the User sends to Language Leaders.
Suspension or Denial of Access
Language Leaders reserves the right to suspend, disconnect, deny, or restrict your access without prior notice. (i) If the Portal or Platform experiences technical failure, modifications, or maintenance, (ii) if the user breaches Language Leaders’s Rules of Use or service agreement, or (iii) if the user’s actions or inactions, in Language Leaders’s discretion, bring about risk towards the operational and integral state of the branches’ facilities, employees, customers, Portal, or Platform, the user’s access may be restricted.
Except for the cases mentioned above, the user can cancel the Language Leaders service at any time. If there are any unpaid charges during the cancellation, they will be settled automatically in favor of Language Leaders by charging the payment methods that the User has provided.
Exclusion of Warranties and Limitation of Civil Liability
The Language Leaders portal or platform may contain links to third-party websites, cookies, resources, or sponsors. The presence of links to and from the Language Leaders portal or platform to third-party sites does not imply any sponsorship from Language Leaders towards the third-party sites, resources, sponsors, or content. Language Leaders is not responsible, directly, or indirectly, for any of those third-party sites, resources, sponsors, or content.
Language Leaders does not endorse or guarantee the accuracy or reliability of any advice, opinion, statement, or information presented or disseminated on the Portal or Platform. Users acknowledge that they are relying on such opinions, advice, statements, or information at their own risk.
Language Leaders and its partners provide no warranties, express or implied, regarding: (i) the content of the Portal and the Platform; (ii) the materials, software, features, and information accessed through the software utilized on the Portal and the Platform or accessed through them; (iii) any third-party products or services or links to third parties on the Portal and Platform; (iv) any security breach associated with the transmission of sensitive information through the Portal and the Platform or a linked site; or (v) any service provided by a third party contracted through the Portal or the Platform.
Language Leaders and its affiliates do not offer any warranties, whether explicit or implicit, including but not limited to warranties of non-infringement or violation of laws or regulations, merchantability, or fitness for a specific purpose. Language Leaders cannot guarantee that the functions within the Portal and Platform, or any materials or content therein, will operate without interruption or errors, that all defects will be fixed, or that the Portal, Platform, or their servers are free from viruses or other harmful components. Language Leaders is not liable for any losses or damages (including indirect, special, consequential, or direct damages) incurred using the Portal or Platform, whether caused by negligence or omission. In cases where the exclusion of certain warranties or terms goes against laws, rules, or decisions, Language Leaders’s only obligation for Services is to provide a re-supply of previously contracted services.
Language Leaders may provide its users with tools to transact or engage with third parties, which may include individuals. Members should take adequate steps when sharing information with these third parties or engaging in any such interactions. It is the user’s sole responsibility for all contacts and interactions with third parties, and Language Leaders shall not be liable for any such contacts or interactions.
Indemnification
By agreeing to this document, the User agrees to indemnify, defend, and hold harmless Language Leaders, its subsidiaries or affiliates, representatives, agents, consultants, directors, owners, employees, collaborators, information providers, partners and distributors. Indemnify the Indemnified Parties from liability and costs resulting from any claims arising from User’s breach of the agreement, unauthorized use of the Portal or Platform content, or violation of the stated representations, warranties, or clauses, including reasonable attorney fees and expenses. The User must cooperate fully as reasonably necessary to defend any claims. Language Leaders reserves the right, at its own expense, to assume exclusive defense and control of any matter that might otherwise be subject to indemnification by it, and the User may not settle any matter without Language Leaders’s written consent.
Modifications to the Portal, Platform, and Terms and Conditions.
Language Leaders reserves the right to make corrections, additions, improvements, or modifications to the Portal or the Platform, including its content, presentation, information, services, areas, databases, and other elements, either partially or entirely, without prior notification to the User. This action does not give rise to any right to claim or compensation, nor does it imply any recognition of liability in favor of the User.
Additionally, Language Leaders reserve the right to modify these Terms and Conditions at any time. These modifications will become effective immediately upon updating the application or publishing on our website, without the need for further notice to the user. We recommend that our users review these Terms and Conditions regularly to stay informed of any changes. Continued use of our services after such changes constitutes acceptance of the new Terms and Conditions.
Language Leaders also reserves the right to terminate or delete any part or content of the application at its discretion without prior authorization or notification to the user.
Applicable Law and Competent Courts
This agreement, including the Terms of Use and any related matters, will be subject to the laws of Mexico. The federal courts located in the state of Morelos will have the jurisdiction to handle any disputes that may arise. For international users, Language Leaders is committed to resolving disputes through amicable negotiations first. If a resolution cannot be reached, disputes will be subject to the jurisdiction of the competent courts located in the state of Morelos, México.
